Copyright Registration with the U.S. Copyright Office

Copyright protects original works, including literary works, musical compositions and songs, pictures, movies, and computer programs. Copyright protection comes into existence the moment an original work is created even without registering your work with the United States Copyright Office or assigning a © symbol on your work product. Registering an original work with the United States Copyright Office offers additional protection and is required in order to bring a lawsuit for copyright infringement against an unauthorized user of your work. It also creates a public record of your copyright ownership rights. For original works created on or after January 1, 1978, protection lasts for the life of the author plus an additional 70 years. For anonymous work, pseudonymous work, or work made for hire, protection lasts for 95 years from the year of its first publication or 120 years from the year of its creation, whichever expires first.

Trademark Registration

It is essential to protect your nonprofit organization’s brand, including your nonprofit name, logo and designs, and catchphrases. By registering your trademarks with the United States Patent and Trademark Office, you are claiming these marks are protected under Federal Law. Trademark protects words, names, and symbols that are utilized to recognize and distinguish creators and providers of goods and services. It will essentially protect your nonprofit organization’s brand name and reputation and discourage others from diluting your mark. There is very limited protection once an organization makes use of a mark in commerce, while more extensive protections arise when the mark has officially been registered with the United States Patent and Trademark Office. Protection endures as long as the mark is actively utilized by the owner and can potentially exist indefinitely.
